Roger Waters, NGOs And Many Others Condemn Revoking Of Amazonian Lawyer Steven Donziger’s Law License

On September 17th, a formal bar licensing hearing in New York was held for Steven Donziger, a lawyer who fought to clean up Chveron’s environmental oil disaster in Ecuador. Donziger ended up being targeted in collusion by a judge and the company in what Amazon Watch, a U.S.-based environmental entity has called, a “well-financed corporate retaliation SLAPP (Strategic Lawsuit Against Public Participation) campaign in history.”
Amazon Watch reports:
“On September 17th, I (Paul Paz y Miño) testified on behalf of Donziger at a formal bar licensing hearing in New York, where for the first time witnesses were able to address the facts of Chevron’s fraud in bringing its retaliatory civil RICO (“racketeering”) case designed to try to undermine the legitimate $9.5 billion judgment won by Ecuadorian communities in 2011.”
“Several witnesses at the hearing explained how Chevron and its lawyers at the infamous Gibson, Dunn & Crutcher firm – led by Randy Mastro, former deputy mayor to Rudy Guiliani – engaged in unethical and illegal acts to target Donziger based largely on the testimony of a corrupt witness who was paid at least $2 million by the company and who later admitted to lying under oath. Many respected lawyers, authors, and activists also testified on Donziger’s behalf. Without exception, all described Donziger as a man dedicated to justice in Ecuador on behalf of Chevron’s victims, who was framed by Chevron and its corrupt witness Alberto Guerra, who claimed without any corroborating evidence that Donziger had approved a bribe to a judge,” Paul Paz y Miño, Amazon Watch’s Director of Outreach wrote.
Amazon Watch further provided a detailed recap of the Donziger saga:
  • In 2011, Chevron was found liable in Ecuador for the deliberate dumping of billions of gallons of toxic oil waste into the Amazon between 1964 and 1992, decimating indigenous groups and provoking an outbreak of cancer that has killed hundreds if not thousands of people.
  • Four levels of courts in Ecuador – including its supreme and constitutional courts – imposed damages on Chevron of at least $9.5 billion; most of the pollution, including an estimated 1,000 unlined toxic waste pits, continue to poison soils, rivers, and groundwater.
  • Having definitively lost the case in Ecuador, Chevron abruptly removed all of its assets from the country and never paid a dime to the affected communities.
  • In the RICO case, Chevron bribed its star witness Alberto Guerra and used false evidence to try to criminalize human rights lawyer Steven Donziger and the Ecuadorian communities fighting for cleanup.
  • Donziger’s law license was suspended in New York based on the allegation that he was “an immediate threat to the public interest” due to his litigation against Chevron.
  • With U.S. District Judge Lewis Kaplan as an ally, Chevron has demanded Donziger surrender his computer and cell phone for inspection by the company so that it can sue or target anybody Donziger has been in touch with, or anyone supporting the campaign for justice in Ecuador.
  • Judge Kaplan has held Donziger in civil contempt, seized his passport, and fined him an exorbitant $200,000 per day for refusing to turn over his computer and phone while an appeal is pending.
  • Judge Kaplan himself then filed criminal contempt charges against Donziger and asked the federal prosecutor in New York to prosecute him; the prosecutor refused.
  • Judge Kaplan then appointed private lawyers from a corporate law firm and deputized them to act as “government prosecutors” to target Donziger. Pending trial, Donziger has been confined to home detention and required to wear an electronic monitoring device for the last two months.
  • Chevron has tried to undermine the very idea of corporate accountability with its unprecedented, unethical, and illegal attacks against Steven Donziger and those who stand up for a proper environmental cleanup in Ecuador.

The “Deep State” Has Been Redefined as Career Bureaucrats Doing Their Patriotic Duty

It gets funny, this shallow analysis of the deep state that is currently big news.  There’s something ghoulish about it, perfectly timed for Halloween and masked jokers.  What was once ridiculed by the CIA and its attendant lackeys in the media as the paranoia of “conspiracy theorists” is now openly admitted in reverent tones of patriotic fervor.  But with a twisted twist.
The corporate mass-media has recently discovered a “deep state” that they claim to be not some evil group of assassins who work for the super-rich owners of the country and murder their own president (JFK) and other unpatriotic dissidents (Malcom X, MLK, RK, among others) and undermine democracy home and abroad, but are now said to be just fine upstanding American citizens who work within the government bureaucracies and are patriotic believers in democracy intent on doing the right thing.
This redefinition has been in the works for a few years, and it shouldn’t be a surprise that this tricky treat was being prepared for our consumption a few years ago by The Council on Foreign Relations.  In its September/October 2017 edition of its journal Foreign Affairs, Jon D. Michaels, in “Trump and the Deep State: The Government Strikes Back,” writes:
Furious at what they consider treachery by internal saboteurs, the president and his surrogates have responded by borrowing a bit of political science jargon, claiming to be victims of the “deep state,” a conspiracy of powerful, unelected bureaucrats secretly pursuing their own agenda. The concept of a deep state is valuable in its original context, the study of developing countries such as Egypt, Pakistan, and Turkey, where shadowy elites in the military and government ministries have been known to countermand or simply defy democratic directives. Yet it has little relevance to the United States, where governmental power structures are almost entirely transparent, egalitarian, and rule-bound.
The White House is correct to perceive widespread resistance inside the government to many of its endeavors. But the same way the administration’s media problems come not from “fake news” but simply from news, so its bureaucratic problems come not from an insidious, undemocratic “deep state” but simply from the state—the large, complex hive of people and procedures that constitute the U.S. federal government.
Notice how in these comical passages about U.S. government transparency and egalitarianism, Michaels slyly and falsely attributes to Trump the very definition – “unelected bureaucrats” – that in the next paragraph he claims to be the real deep state, which is just the state power structures. Pseudo-innocence conquers all here as there is no mention of the Democratic party, Russiagate, etc., and all the machinations led by the intelligence services and Democratic forces to oust Trump from the day he was elected.  State power structures just move so quickly, as anyone knows who has studied the speed with which bureaucracies operate. Ask Max Weber.
Drip by drip over the past few years, this “state bureaucracy” meme has been introduced by the mainstream media propagandists as they have gradually revealed that the government deep-staters are just doing their patriotic duty in trying openly to oust an elected president.
Many writers have commented on the recent New York Times article, Trump’s War on the ‘Deep State’ Turns Against Him” asserting that the Times has finally admitted to the existence of the deep state, which is true as far as it goes, which is not too far. But in this game of deceptive revelations – going shallower to go deeper – what is missing is a focus on the linguistic mind control involved in the changed definition.
In a recent article by Robert W. Merry, whose intentions I am not questioning – “New York Times Confirms: It’s Trump Versus the Deep State”– originally published at The American Conservative and widely reprintedthe lead-in to the article proper reads: “Even the Gray Lady admits the president is up against a powerful bureaucracy that wants him sunk.”  So the “powerful bureaucracy” redefinition, this immovable force of government bureaucrats, is slipped into public consciousness as what the deep state supposedly is.  Gone are CIA conspirators and evil doers. In their place we find career civil servants doing their patriotic duty.
Then there is The New York Times’ columnist James Stewart who, appearing on the Today Show recently, where he was promoting his new book, told Savannah Guthrie that:
Well, you meet these characters in my book, and the fact is, in a sense, he’s [Trump] right. There is a deep state…there is a bureaucracy in our country who has pledged to respect the Constitution, respect the rule of law. They do not work for the President. They work for the American people. And, as Comey told me in my book, ‘thank goodness for that,’ because they are protecting the Constitution and the people when individuals – we don’t have a monarch, we don’t have a dictator – they restrain them from crossing the boundaries of law. What Trump calls the deep state in the United States is protecting the American people and protecting the Constitution. It’s a positive thing in this sense.
So again we are told that the deep-state bureaucracy is defending the Constitution and protecting the American people, as James Comey told Stewart, “in my book, ‘thank goodness for that,’” as he put it so eloquently. These guys talk in books, of course, not person to person, but that is the level not just of English grammar and general stupidity, but of the brazen bullshit these guys are capable of. MORE

To Get Perspective on America's Broken Health Care System, Talk to a British Doctor

We have decided the absurdities voices by these self-serving crumb-cakes need to be confronted with facts and humor.  We all need health care, and the facts, so assiduously hidden from us, need to be revealed.  

So, now, about Universal Health Care, we can all have!

Percentage As You Earn (%PAYE) mutual medical Finansurance of Human Investments (HI) offers ALL people in a free-market what they want and need. Every point made by this British doctor against Rigid Installment Payments (RIP)s as Insurance Premiums is correct. Yet his shallowness in thinking that a needs analysis group medical Soviet is adequate is belied by the tax allocation gossamer-thin resources causing deadly waiting for service that is as horrible as letting people die because they have no money at the moment; which is logical when ill or injured. 

In contrast, Human Investments by agreement for what an individual wants and needs is financed. Why? A pre-existing condition is keeping you from earning a living or weighs on the time and income of a parent, or just staying alive allows you to function as an economic personality. So fix it, and rePAYE the assistance that allows you to make a living. Don’t steal that investment, and be a taxpayer to help another with one size and policy fits all; make a 7-year contract for your genetic therapy or servo-mechanism prosthetic. 

Then finance your usual risks of probabilities most call insurance. Finance of unaddressed backlog of pre-existing conditions is not insurance against various bad things happening in the future. However, both can be PAYEd the same way, by a percentages-of-income. Further, if you WANT an Ironpersson Suit where you can lift steel beams all day like pick up sticks, then that Personal Income Improvement Investment (Piii) is about 3.5% more of income, or about that of rePAYEing a college tuition to become a doctor that you wish to do. 

The NHS bankrupts the Brits as a whole versus point bankruptcies for medical debt. That “cure” is as ridiculous as the British House of Lords in 1845 wanting to end debtors’ prisons, so they turned the whole country into a debtors’ prison by being unable to own anything until a lockstep RIP was paid. In America, emulating the foolish Brits, Issac Singer sold sewing machines in 12 easy payments. Trouble is, that system isn’t very wise for big-ticket items like buying a house, medical care, a vehicle, a college education. The fantasy is that nothing bad will ever happen to you in any given 6 months, or the predator lender with a sheriff shows up to steal $200,000+ of equity because you had a few months bad luck. Such crystal balls fall off  RIP installment tables and crack up with people’s lives. RIP & strip of equity was a Brit invention. However, this UK doctor doesn’t seem to know much about how America was built and financed person by person before the insane RIP-off system began. 

A generation after the Brits thought up colonization by 100% indentured servitude, the capitalists of immigrants discovered few were motivated. After the first 6,000 colonists of 7,000 died at Jamestowne from malaria in the mosquito invested Chesapeake colony, the indentures were willed to other survivors and monetized to 7% of your income as a free person for 7 years to rePAYE the merchant-adventurer who got you to America.  

In the south, King James nationalized the Virginia Company of Adventurers Trading Out of London for perceived mismanagement, started the Royal African (Slavery) Society, and shipped thieves and debtors to America. However, north of Virginia, 100 land development companies in New England, New France, and New Amsterdam used the percentage-of-income rePAYEment system they learned from the natives that charged them 20% for fishing rights, a bauble for transit rights, 5% for farming rights. Peace reigned. 

Soon 1,000,000 immigrants decided to become “Redemptioners of Debt” by rePAYEing their expensive passage across the Atlantic, a grubstake for a family of 6, and tools to start a new life. All medical care for all people was income-contingent for the same percentage of income for rich or poor. Judges were Pre-PAYEd a percentage-of-income before a case by opposing rich and poor, to be impartial, lawyers were also rewarded on an income-contingent fee if they won. 
Americans, after 150 years decided the British subsidized and forced monopoly on tea, among other things was a bad idea. 792 investor-owned, privately-armed, Privateer warships were capitalized by ladies with gold pieces to buy gunpowder and ropes. They asked 1/3rd if captured Brit ships. The crew divided the 2/3rds by 20 functions and the number of service providers in that function. There was even 1/20th of the 2/3rds as merit pay for hulling the Brit ship or killing its officers. The death-dealing was as efficient as medical providers in Massachusetts. Over 3,100 British ships were captured. Everything Georgie Washington as muskets and powder to fight with was captured from the forced subsidized monopolists of tea among other things.

I was deeply shaken while witnessing yesterday’s events in Westminster Magistrates Court. Every decision was railroaded through over the scarcely heard arguments and objections of Assange’s legal team, by a magistrate who barely pretended to be listening.
Before I get on to the blatant lack of fair process, the first thing I must note was Julian’s condition. I was badly shocked by just how much weight my friend has lost, by the speed his hair has receded and by the appearance of premature and vastly accelerated ageing. He has a pronounced limp I have never seen before. Since his arrest he has lost over 15 kg in weight.  MORE

Those are soundbite-a-thons, we will have the real debates for 47-minutes minus commercials and instructing the audience how to PhoneVote and ask questions on issues and candidates on-air and on website landing pages. One of the three debate tracks in Environmental / Cultural Legal & De-Legalization Leadership, the others being Foreign Policy and Economic Vision. Understand the wannabe presidents are just an excuse for the audience to find real solutions to problems. The rest of our programming is viably free-market and persuasion. 

We do have another exception which is CongressionalClearinghouse.com where Americans can actually post charts, graphs, evidence, videos, pictures, and all the other stuff that the house.gov and senate.gov websites for 20 years have excluded, so the congress critters decapitated themselves from Americans who would like to tell or show them something, anything. We are looking for producers/ content-leaders there to operate that nexus point of opinions too. Maybe you have some friends.

I signed your petition only because I agree with you on the issue, but I was disappointed to see you drinking political Kool-Aid as a savior of your cause as the only plan of action. I assure you no politician is a solution, and a pretense to invoke rules or regulations get watered down with compromise with your opponents; then that gets to be a far cry from your moral clarity, sense of justice, and you wonder what it was all for at the bitter end. In contrast, winning a popular majority in Culture Wars in the court of public opinion, is actually more solid ground when you win by persuasion, and are willing to take on opponents uncensored, get sharp, and keep winning by persuasion when robotic enhancement is the next issue you'll be up to distinguish yourselves from. Note Special Olympics already exist. 

Respecting minority rights is clearer against those that wish to use force for their point of view for either majoritarian or minority points-of-view. People can organize sports for instance in a variety of ways. For instance, I am 5'5" and I like basketball. I can whine about discrimination, force my way onto the NBA and steal ground balls all day; but that doesn't even mean I'll make a dunk or even take a shot. In contrast, I can start a Shrimp Nationwide Basketball League with height classes and or lower the basket to I can make those dunks. I can find sponsors form Jimmy Au's Short and Small Clothiers with famous short stars like Dustin Hoffman, Tom Cruise, Robert Redford. A third of the audience will like to watch b-ball who can relate to skill and their height, and not being shut-out by a genetic anomaly. The medium-size folks will watch their welter-weights in their League, and the giraffes are already covered in the NBA. It's not a threat to the NBA anymore than the WNBA is, plus it widens the sport out to more people to enjoy it, not make it a never-winning chore for some groups due to physical genetic nature. I intend to do this. 

From 1996 for 25 years, as a teacher in schools, I advocated for a balance of funds for girls' sports in government, private, and parochial middle & high schools. I find it ironic that that battle was won by popular will and many grassroots meetings, not laws from above; as compared to your petition of a politician. Try that grassroots strategy again, only this time with interactive TV to speed it up. Even if Maureen is a lawyer, maybe she'll get persuasion as more effective, and also be able to guard yours and our rear flank from any media law attacks. Our new channels' policy is no censorship, no shadow-banning, and take on all comers. Controversy and Debate are good and good for ratings and involves everyone. it is not boring one-hand clapping to the right or left as CNN with 157,000 TV viewers and 1.1M phone app viewers, or Foxnews with 1.5M viewers and 300k phoneapp viewers. These are actually small numbers, we can take these passive networks out with higher ratings interactive TV, and that is best with your controversy. Don't beg for airtime, be the show. 

The top 5 passive TV networks only are that because they have at least one interactive show on their roster that pumps them up. So you think you Can Dance? holds the record for the most phone calls/texts/online PhoneVotes in a 3-hour period = 94-million. That is almost as many people as vote for president, and they do it weekly in their finals. You can create a transgender birth male genetic league, and a transgender birth female league in any sport, and add the physical classes to that, or do that anyway in any sport so us smaller folks don't always get aced out. we can win something. Enough folks in any class can create their own league. Little schools have 5-person football, big one 11-person football. Get it? 

Further, we dazzled some the top connectivity companies that handle 800 channels with our Charity Champions overlay TV network and niche-market new Leagues, where either a team or individuals on a team can be playing, racing, for a charity (including yours). This includes Secondary Education, College, and Pro Sports who can play for more than whose best, or a sponsors' money purse, the audience can pledge to the charity of the players, including yours. That idea was advanced to me by Dale Earnhardt Sr., and now the technology makes it possible to work for 14-million Girl Scouts and their families cheering for a Girl Scout racecar, pledging money to its standings as successful, buying cookies, or 10-milllion girls inquiring about why a girl should join the GS on a video downloadable from an allied cloud company to our "Content Delivery Network" (CDN). Maureen can make such phone-calls and PowerPoint presentations for allies and sponsors for such arrangements and write the contracts too. We can aim her in the right direction as a producer. 

This is a strategy that will win, will be self-funding with a bit of pump-priming with lady-related sponsors for female-genotype persons.
