The Regulation Freedom Amendment in December

The time for to stop Obama's regulators is NOW!

If we don't introduce legislative measures to empower states, NOW in time for the January 2014 legislative sessions, we won't be ready to force Congress to propose limits on federal regulation in 2015.

Give a "Christmas present" to Obama's regulators by spending a little time helping to build grassroots support for the Regulation Freedom Amendment.

Our key priority in the next 18 days before the pre-Christmas weekend is finding more State legislators, especially House Speakers, Senate Presidents, and Majority Leaders in the 24 key states with GOP majorities and legislative sessions in 2014 who will back the Regulation Freedom Amendment and the 10th Amendment law like the one signed by Gov. Pence in Indiana.

Deadlines for introducing legislation are rapidly approaching.

The endorsement of major Tea Party Leaders in our key states can help us get the attention of those legislative leaders.

Individual Tea Party volunteers willing to spend a few hours personally emailing and calling people could generate some powerful endorsements.

Anything you can do to help us find individuals willing to spend time would be helpful.

And if you can help, just pick a state, google "Tea Party Leaders in _____" and use the list of websites to get email and phone information for leaders. Use the email address to see if you can generate enough interest to get a phone number.

Hello, my name is _________ and I want to ask if you have a couple of minutes to hear about a new idea backed by two former Governors and a founder of the federalist society for how Tea Party volunteers like us, can help take away the power of federal (or Obama's) regulators.

And by the way I am calling to ask for your support, NOT for money.

This idea is called the Regulation Freedom Amendment and it would take away the power of federal (or Obama's) regulators by requiring that Congress approve major new federal regulations
before they could take effect.

And best of all, 2/3 of the states could  force Congress to do it!

The strategy, is based on an idea Ed Meese originally proposed when he was Reagan's Attorney General.

The details were developed by a legal team led by the lawyer for the 26 states who sued to overturn "Obamacare"
(His name is David Rivkin, whose op eds. you may read in the Wall Street Journal)

As I mentioned the group working on it, the "Madison Coalition"  is led by 2 former Governors ( George Allen from VA and Bob Ehrlich from MD) and a co-Founder of the conservative "Federalist Society" (Former Cong. David McIntosh of Indiana).

The key is using the power of endorsements from grassroots volunteers like us to show state legislators how they can rein in the abuses of power by politicians in Washington.

The Madison Coalition is working with several State House Speakers (including (Scott Bedke of Idaho and Tom Lubnau of Wyoming) and Senate Leaders (including Senate Majority Leader mark Norris of Tenn and Senate President David Long of Indiana). We are talking to legislators in more than 40 states and our effort already has bipartisan support.

Because state legislators in all but a few liberal states don't like bureaucrats in Washington, we think that 34 states could force Congress to propose the Regulation Freedom Amendment to the U.S. Constitution as early as 2015.

To strengthen the power of states to force Congress to rein in federal regulators, a majority of states need to enact a new kind of "10th Amendment-based state law like one just signed by Governor Mike Pence of Indiana.

These laws, passed in just a majority of states, for example the 28 states with GOP majorities in the legislature, would give states the power to safely force Congress to propose the Amendment.

If, after hearing about our strategy,  you like what we are doing we would like you to consider endorsing the Regulation Freedom Amendment and for the 10th Amendment law that will empower the states to force Congress to propose it.

Q: HOW DOES OUR STRATEGY WORK?

A: Our first step is to build support among business and grassroots volunteer leaders for the Regulation Freedom Amendment  and to pass Resolutions in early 2014 in state legislatures urging Congress to support the Amendment.

The second step, also in 2014 is to get a "10th Amendment"-based "empower the states"  law like one just  signed by Governor Mike. Pence in Indiana  passed in a majority of states, for example, those with Republican majorities in the legislature.

If passed in those states, the law would give 2/3 of the states the ability to safely force Congress to propose the Amendment.

Then, after the 2014 elections, if Congress hasn't already proposed the Amendment, the third step is for legislative leaders in at least 2/3 of the states (34) to  introduce what legal experts call Article V Resolutions. These Resolutions would force Congress to propose the Amendment.

The Resolutions would give Congress an easy choice. Either propose the Amendment, or be forced to call a Convention that states could strictly limit to just an up or down vote on the Amendment.

Four times in American history Congress has proposed the Amendment to avoid a Convention, because Congress fears a Convention that would be more powerful than Congress.

The 10th Amendment laws passed in a majority of states 2014 would give states the power to limit the Convention to an up or down vote on just the Amendment states want, and thus avoid any risk of a so-called "runaway convention".

The laws would empower each state to replace any delegate to a convention who ignored state limits on his or her authority.

So by passing these 10th Amendment laws  states can empower themselves to  safely force Congress to propose the exact Amendment states want.

The bottom line is that passing these laws would give 2/3 of the states the ability to curb the abuse of federal starting with a requirement that major new federal regulations be approved by Congress before they can go into effect.

That could open the door for other Amendments, for example a balanced budget amendment.

Q:  HOW DOES THE 10th AMENDMENT LAW WORK?

A: The 10th Amendment laws  would give states to power to limit the authority of their delegates to the Convention they threaten to the limits on the convention set by the Article V Resolution passed by the state. For example delegates could be limited to just an up or down vote on the specific Amendment the states have proposed.

Anyone wishing to be considered. For selection as a delegate from the state would be required to pledge to obey the law and agree they could be replaced and punished if they violated the limits on their authority.

If a majority of states with a majority of the population passed the law, for example just the states that now have Republican majorities in the legislature, a majority of the delegates at any Convention would be required to ensure that the convention could only vote up or down on the specific Amendment.

We have broad support for this law including the current and former General Counsels of the Republican National Committee, the National Taxpayers Union, the Balanced Budget Amendment Task Force and many other legislators and legal experts.

Q:  HOW CAN WE GET THE SUPPORT OF 34 STATES?

A: We start with the support of the 28 states with Republican majorities in the state legislature.

We add Democrats in the energy West Virginia and Kentucky who also dislike federal regulators.

Republicans can win back control of the legislature in 2-4 states where they recently held majorities for example ME, NH, IA, and MN.

We win the support of reasonable  Democrats in at least 1-2 other moderate states like NM, CO, NV or DE who prefer to support making bureaucrats accountable to elected officials rather than being identified as "rubber stamps for federal regulators".

With the support of 34 states we can force Congress to propose the Amendment!

Q: HOW CAN I AND PEOPLE LIKE ME MAKE A DIFFERENCE?

A: First, we'd  your endorsement for #1  the Regulation Freedom Amendment and #2  a 10th Amendment law like the one signed by Gov. Pence in Indiana that empowers states to force Congress to propose it.

These endorsements will help us persuade legislators in ______ to sponsor and support our legislation.

#1 The Regulation Freedom Amendment to the U.S. Constitution requires that Congress approve major new federal regulations.

Here is the text of the Amendment:

THE REGULATION FREEDOM AMENDMENT

"Whenever one quarter of the Members of the U.S. House or the U.S. Senate transmit to the President their written declaration of opposition to a proposed federal regulation, it shall require a majority vote of the House and Senate to adopt that regulation."

Among our other supporters are the National Taxpayers Union, Americans for Tax Reform President Grover Norquist, and Tea Party leaders like the President of the Mississippi Tea Party Laura Van Overschelde.

We need more endorsements and volunteer help now to build support  for the state 10th Amendment laws and Resolutions endorsing the Regulation Freedom  Amendment.

The deadlines for introducing legislation are fast approaching and we need to show legislators in December how much support we have.

THE BOTTOM LINE:

It will take years and cost millions before we get enough votes in the U.S. Senate and a President willing to sign a law to make bureaucrats more accountable and limit their power to impose regulations.

But by empowering states, we can build a "rein in the regulators" coalition outside the beltway, where Washington bureaucrats are least popular.
