At a fourth-of-July DUI checkpoint in Murfreesboro,Tennessee, State Trooper AJ Ross angrily screamed orders and performed an illegal search on a well-informed innocent driver who filmed the encounter.
The 21-year-old driver refused to cooperate with lowering his window enough for Trooper Ross and Ross decided that he would have to pay for his noncompliance.
The citizen refused to consent to a search and could be heard repeatedly answered "Am I being detained?" when he was given a command. But the police were not taking no for an answer.
The driver describes the event on YouTube saying "Trooper AJ Ross orders me to pull over and get out of my car, bullies me around, gets the drug sniffing K-9, lies about me having 'Illegal drugs' in the car, searches without consent, and tells me that it is ok to take away my freedom."
After the drug dog handler spurs the dog to give a false signal (caught on camera), the troopers demand to search the car.
When the police find nothing in the car, Trooper Ross begins to grow nervous that he's violating the rights of someone who actually knows his rights.
"He's perfectly innocent and he knows his rights," Ross tells another officer while searching the car, "He knows what the Constitution says."
Then Ross discovers the camera that's been recording the entire time. Although the camera didn't it pick up, the driver alleges that Ross told him that his "Constitutional rights did not matter at checkpoints."
"I broke no laws whatsoever," the driver laments. "All of this on a day that we are supposed to be celebrating freedom and liberty."
